About PEXA

What is PEXA?

PEXA (Property Exchange Australia) is Australia’s online property exchange network. It assists members – such as lawyers, conveyancers and financial institutions – to lodge documents with Land Registries and complete financial settlements electronically.

PEXA was formed in 2010 to fulfil the Council of Australian Governments’ (COAG) initiative to deliver a single, national e-Conveyancing solution to the Australian property industry. It was originally known as National e-Conveyancing Development Limited.

PEXA is committed to supporting the property industry as it transitions towards a 100% digital conveyancing process that’s fast, safe and efficient.

This provides an opportunity for you to connect and come together with other members of your network by sharing your experiences and maximising the efficiency gains e-Conveyancing offers.

Staying safe and secure 

PEXA is regulated by the Australian Registrars’ National Electronic Conveyancing Council (ARNECC) . ARNECC consists of Land Title Registrars (or their nominees) from each state and territory and was established to facilitate the development of and ongoing maintenance of, the regulatory framework for electronic conveyancing.

Under the Electronic Conveyancing National Law (ECNL), ARNECC has determined Model Operating Requirements (MORs) and Model Participation Rules (MPRs), with which Electronic Lodgement Network Operators (ELNOs) and their subscribers must comply. Currently, PEXA is Australia’s only electronic conveyancing platform.

To ensure the integrity of the network, the Australian Registrars’ National Electronic Conveyancing Council (ARNECC) has developed a regulatory framework, under which PEXA operates. Industry safeguards include the Participation Agreement, Verification of Identity and Digital Certificates.

Subscriber policies and agreements

To further ensure the integrity of the network, PEXA has a number of subscriber policies and agreements in place. These include the Participation Agreement, Service Charter and Security Policy amongst others.

  1. The Electronic Conveyancing Group comprises the Australian Bankers’ Association, Australian Institute of Conveyancers and Law Council of Australia. As representatives for their respective industries, PEXA and the ECG work closely together in creating ongoing improvements and efficiencies through variations to the Representative Subscriber Participation Agreement. 

  2. ABA and COBA act as Representative Bodies for the Financial Institution Subscribers within the network. PEXA consults with the ABA and COBA for all proposed variations to the Financial Institution Participation Agreement and Service Charter.

    PEXA also works closely with the ABA and COBA on behalf of their respective members in relation to industry reforms, such as the National Mortgage Form.

  3. The AIC are an incredible supporter of the digital efficiencies borne through PEXA and assist their members through a robust Electronic Conveyancing Accreditation Program. PEXA works closely with the AIC at both a state and national level through conferences, publications and industry sessions. 

  4. The law societies in each state support industry transformation by exchanging news, information and articles for publication. The state law societies also co-present industry events about online property settlement with PEXA.

What are PEXA Sponsors?

Registered members can choose to access PEXA directly or via a Sponsor. PEXA Sponsors are also known as information brokers or conveyancing software providers. They intend to integrate their existing product offerings with PEXA to provide end-to-end solutions to property lawyers and conveyancers.

Sponsors will then enable access to the full suite of PEXA functionality, plus a number of services that PEXA does not offer, such as land title and company searches.

How much does it cost?

PEXA members pay only per successful transaction. PEXA does not charge up-front registration fees or ongoing subscription fees. Charges vary based on the type of transaction. This PEXA fee is separate from the statutory lodgement fees, which are set by each jurisdiction’s Land Registry.

The PEXA fee covers services such as: 

  • Pre-population of Land Registry data.
  • Lodgement verification checks.
  • Title activity checks.
  • Electronic disbursement of funds.
  • Electronic settlement booking.
  • Document creation.
  • Real-time lodgement.
  • Secure digital signing technology.
  • Stamp duty verification.
  • Lodgement gap cover, which is automatic for purchaser clients and subject to the conditions in the Representative Subscriber Participation Agreement.
